TERMS AND CONDITIONS

These Terms and Conditions govern your use of the Blacksmith Cycles service and website. By visiting the Blacksmith Cycles website, you accept, and agree to, the content of these Terms and Conditions. We reserve the right to change the Terms and Conditions at any time and it is your responsibility to check regularly before ordering. This does not affect your statutory rights.

Information about company (Blacksmith Cycles)

  1. INTRODUCTION

By placing an order via our website, you are offering to purchase a product or engaging a service and subject to the following terms and conditions with Blacksmith Cycles LTD (trading as Blacksmith Cycles) incorporated and registered in England and Wales as a Private Limited Company with number 13629473 whose registered office is at 131 Millard Terrace, Heathway, Dagenham, RM 10 8RQ.

2. PRICE
2.1 All prices are quoted in British Sterling.
2.2 All prices are plus postage by UPS, DHL, DPD, Interlink Express, Royal Mail or TNT.

3. PAYMENT
3.1 Payments must be made in British Sterling unless otherwise specified, and by one of the following payment methods

  • Major credit cards as listed: Visa, MasterCard, Delta, Switch, Maestro and Visa Electron
  • PayPal to info@blacksmithcycles.co.uk
  • Bank Transfer to blacksmith Cycles by prior agreement (contact Blacksmith Cycles for details)
  1. DELIVERY ( Products & Accessories )
    • UK Delivery:
      Any date or period for delivery shall be considered as indicative only, although it is our policy to try to despatch all orders within 5 working days. Any products not available at the time of your order will be sent to you, as soon as possible, when received from the manufacturer. Blacksmith Cycles cannot be held responsible for delays in the delivery caused by the manufacturer, or any other third party. Orders will be shipped via UPS, DHL, DPD, Interlink Express, Royal Mail or TNT dependent on customer selection. Most packages arrive within 5 business days. Blacksmith Cycles have the right to fluctuate prices in proportion with their costs.
  1. OVERSEAS SHIPPING As above (4.1). Any duties taxes or charges made by 3rd parties once goods have left Blacksmith Cycles premises are the sole responsibility of the customer.

4.2 PASSING OF RISK In the event of an order being lost by a third party Blacksmith Cycles bears no risk once it has left their trading premises. Where goods have been received damaged, a refund/exchange application will only be acknowledged if the goods are returned together with their original packaging within 14 days of order to Blacksmith Cycles trading address.
Where the goods are signed for, if a customer believes that a parcel has been tampered with, it is their responsibility to refuse to sign for the goods.
In the event of either of the above, Blacksmith Cycles will forward a claim to the courier: on the behalf of the customer.
To initiate a product return please follow the instructions listed in Clause 6.2

This is not a guarantee and Blacksmith Cycles has the right to refuse any application. Any refund/exchange given is at the discretion of the management of Blacksmith Cycles. Failure to give accurate information while making a claim may lead to a prosecution from UPS, DHL, DPD, Interlink Express, Royal Mail, or TNT.

5. ACCEPTANCE
The Customer shall inspect the Goods within a reasonable time after their receipt and shall be deemed to have accepted the goods unless within 14 days after their receipt the Customer shall have notified the seller that the goods are rejected. (This does not however affect the customer’s statutory rights). If no such action has been taken, Blacksmith Cycles shall consider the products being as described, of satisfactory quality and fit for their purposes, and may not accept any rejection at a later date.

6. RETURNS PROCEDURE
6.1 If the goods are to be rejected in the time limit set in clause 5 above, the Customer shall comply with the return procedure as defined in clause 6.2, below. Blacksmith Cycles will not accept any returned goods should the return not follow the aforementioned return procedure.
6.2 The Customer must apply for returns authorization through email or call. Please call Blacksmith Cycles to initiate the procedure.
Any opened or damaged products will not be eligible for a refund/exchange. It is advisable that a certificate of posting is obtained.
6.3 In cases where the rejection of the goods is due to a defect or discrepancy in the order, the Customer is entitled to a full refund or replacement. The faulty or damaged product must be returned to Black Smith Cycles before the refund or replacement can be issued.
6.4 In cases where the rejection is due to an incorrect order from the Customer or to dissatisfaction, the Customer is entitled to a partial refund (full refund less postage costs) only. Goods must be returned to Blacksmith Cycles before the partial refund can be issued.
6.5 In cases where the customer does not sign for the goods on delivery or for whatever reason, they are not accepted by the customer and returned, we will offer either to re-send the package (which will incur the original shipping charges again), or to refund the original payment minus shipping charges. Only goods purchased from Blacksmith Cycles by the customer can be returned and exchanged by The Adventure Bike Shop. (items distributed by The Adventure Bike Shop, but purchased from a 3rd party supplier must be returned to the supplier)

7. CANCELLATIONS
7.1 Cancellations are only accepted if the Customer complies with the following cancellation procedure and before the order has been despatched. If the order has been despatched prior to the cancellation, the return procedure as defined in clause 6 (6.2 and 6.4) above will apply. If the procedure is not respected, the order will be considered valid and the Customer will remain liable for the full payment.
7.2 Cancellations can be made via Blacksmith Cycles email address info@blacksmithcycles.co.uk. If the goods have already been despatched, Blacksmith Cycles cannot refund any monies spent on postage & packaging. (clause 6.2 & 6.4)

  1. GENERAL TERMS CONDITIONS OF SALES

 

  • Online Bookings / Collect /Return bicycle

 

8.1.1 Collection/Return Specific dates may be booked via our website for our Collect & Return service. Blacksmith Cycles offer Silver, Gold, Platinum, Brompton Special, Build bike from box and Cargo bike bicycle services (the “Services” and each a “Service with our Collect & Return Service. However, we will be happy to undertake additional work on your bicycle with one of these services. Collection/Return Specific dates may be booked via our website under Services.

 On booking we will take either:

(1) a non-refundable £30.00 deposit to secure your booking or

(2) the full price of the relevant Service.

Whatever charge we take on the booking will be deducted from the final cost.

 You will receive a confirmation of your collection and return date and time slots

 (AM: 09:00 – 12:00 or PM: 14:00 – 18:30).

Our driver will also contact you on the collection/return date to confirm either an AM or PM collection/return approximately 2 hours prior to the collection/return of your bicycle. On arrival at the confirmed collection/return address, our driver will contact you and will wait for 10 minutes. Please make sure you are prompt to leave your bicycle/collect your bicycle, otherwise, the driver will need to leave to go to his next appointment. Customers are advised to keep their mobile phone handy before their collection/return visit. Special instructions and/or requests should be supplied.

  1. IMPORTANT INFORMATION REGARDING CANCELLATION OF ONLINE BOOKINGS

9.1 Cancellation prior to collection of your bicycle.

 If the customer wants to cancel their online booking, we can be flexible and will happily reschedule your appointment, these subject to the following:

(a)You must give us 24 hours’ notice:

  • 24 hours’ notice if you intend to cancel/change your collect/return slot
  • ahead of your confirmed collect/return date if there are any times you cannot our driver

(b)If you are unable to meet our driver with your bicycle, please arrange for someone you trusted to do so instead and let us know.

 If you do not attend the scheduled appointment without making an appropriate cancellation or alternative arrangement with Blacksmith Cycles, Blacksmith Cycles shall be entitled to retain:

 (a) Any deposit paid, and

 (b) fifty percent (50%) of the relevant advance payment and Blacksmith Cycles shall refund to you the remaining fifty percent (50%) of such advance payment.

9.2 Cancellation following collection of your bicycle but prior to commencement of instructed work

Once we have collected your bicycle, you have the right to cancel at any time before the instructed work has commenced. However, Blacksmith Cycles shall be entitled to retain:

(a) any deposit paid; or

(b) fifty percent (50%) of the relevant advance payment for the relevant Service. Blacksmith Cycles shall refund to you the remaining fifty percent (50%) of such advance payment.

 9.3 Cancellation following collection of your bicycle and commencement of instructed work

Where costs have been incurred you will only pay for the work completed or the cost incurred. Payment for costs incurred will be required prior to the return of your bicycle. Deposits will be refunded only if no costs have been incurred.

  1. BICYCLE SERVICING & TECHNICIAN RECOMMENDATIONS

 Prior to carrying out your booked service, our technicians will undertake an assessment of your bicycle to determine the condition of your bicycle and may contact you to advise of any additional work that may be required and/or parts that may require replacing. We will not undertake any additional work without your consent, however, if you chose not to follow our recommendations, we cannot guarantee that your bicycle will work as it should. We will however, do what we can to make your bike roadworthy.

Blacksmith Cycles will not be liable for any economic losses arising in any manner whatsoever out of any delays to, or complications with, the fulfilment of any booking for or arising out of any bicycle servicing, repair and or maintenance work you have asked us to undertake, provided that nothing in these terms limits or excludes Blacksmith Cycle liability for death or personal injury caused by its proven negligence.

 10.1 Bicycle Safety Checks

We carry out a safety check of your bicycle to check whether your bicycle is roadworthy. At the end of the check, our technician will provide you with a report on the condition of your bicycle. No work is carried out on your bicycle without your consent. However, if you chose not to follow our recommendations and/or continue to use your bicycle which has failed the Bicycle Safety Check, you do so at your own risk.

10.2 Bicycle Servicing Prior to carrying out any services, our technicians will undertake an assessment of your bicycle to determine the condition of your bicycle and may contact you to advise of any additional work that may be required and/or parts that may require replacing.

We will not undertake any additional work without your consent, however, if you chose not to follow our recommendations, we cannot guarantee that your bicycle will work as it should. We will, however, do what we can to make your bike roadworthy.

 10.3 Stand Alone Repairs We will not undertake a full assessment of your bicycle if you only ask us to undertake an individual/standalone repair(s). However, it may be necessary to undertake further work and/or replace additional parts as a result of a standalone repair. We will not undertake any additional work without your consent, however, if you chose not to follow our recommendations, we cannot guarantee that your bicycle will work as it should. We will, however, do what we can to make your bike roadworthy.

 10.4 Completion of work We will endeavour to complete any work on your bicycle on the day of our service visit. However, there may be times when this is not possible. If that is the case, we may need to return your bicycle to our workshop to complete the servicing and/or repairs and return it as soon as reasonably possible. Blacksmith Cycles will not be liable for any economic losses arising in any manner whatsoever out of any delays to, or complications with, the fulfilment of any booking for or arising out of any bicycle servicing, repair and or maintenance work you have asked us to undertake, provided that nothing in these terms limits or excludes Blacksmith Cycle liability for death or personal injury caused by its proven negligence.

11.IMPORTANT INFORMATION REGARDING CANCELLATION OF ONSITE SERVICING AND BICYCLE ROADWORTHY CHECKS (MOTS) AT YOUR PLACE OF WORK

11.1Cancellation prior to the date of our service visit

We are a small business and as such, it is very difficult to manage last hours minute cancellations. However, we do try to be flexible and will happily reschedule your appointment if you find you can no longer make your appointment, provided that you give us 24 hours’ notice if you intend to cancel/change your service slot If you do not attend the scheduled appointment without making an appropriate cancellation or alternative arrangement with Blacksmith Cycles, Blacksmith Cycles shall be entitled to retain:

(a) Any deposit paid; or

 (b) fifty percent (50%) of the relevant advance payment and Blacksmith Cycles shall refund to you the remaining fifty percent (50%) of such advance payment.

11.2 Cancellation following commencement of instructed work

 Where costs have been incurred you will only pay for the work completed or the cost incurred. Payment for costs incurred will be required prior to the return of your bicycle. Deposits will be refunded only if no costs have been incurred.

  1. STORAGE CHARGES & DISPOSAL OF YOUR BICYCLE

 Under normal conditions, no storage charges will be applied, however, storage charges will be payable to Blacksmith Cycles in relation to any abandoned bicycles or bicycles not collected from Blacksmith Cycles for a period of 5 working days following completion of the work undertaken by Blacksmith Cycles on such bicycle. Storage charges will be payable at the rate of £10.00 per 24 hours. Blacksmith Cycles retains the right to dispose of any bicycle that has remained in our possession for more than 2 (two) months.

  1. ACCEPTANCE OF OUR PRIVACY POLICY TERMS

By using this site and providing us with your information, you agree to the Blacksmith Cycles Privacy Policy. If you do not agree to this Policy, please do not use our site. We reserve the right, at our discretion, to change, modify, add, or remove portions of this Policy at any time. Please check this page frequently for changes. Your continued use of the Blacksmith Cycles site means you accept those changes. You can email us with any further questions you may have.
Please note, credit card details are not retained. The only information stored is a customer’s transaction history, plus address and contact details as entered in the account setup process. These may be used for marketing purposes by Blacksmith Cycles only. Customers will not be sent ‘spam’ e-mail. Should any customer not want their details used for marketing purposes, please request to be removed at info@blacksmithcycles.co.uk

14. LICENCE AGREEMENT
The Customer shall respect all licence agreements delivered by the copyright owners. Blacksmith Cycles cannot be held responsible or liable for any misuses conducted by the Customer or any third party. All trademarks shown on www.blacksmithcycles.co.uk belong to their registered owners and must not be copied without prior permission.

15. LAW
These terms and conditions are governed and shall be interpreted in accordance with English Law. Any person attempting to make fraudulent credit card transactions will be prosecuted with no exception.
